I. GENERAL PROVISIONS

These Terms and Conditions define the rules for using the online store available at
https://sklep.dawidgodziek.com.

  • Seller – Dataland Sp. z o.o. (4-bike.pl), adres: ul. Wiślańska 26 43-430 Skoczów, NIP: 5482559919, KRS: 0000309832, REGON: 240940645, e-mail: biuro@4-bike.pl, tel.: 575444731
  • Domain Owner – Dawid Godziek, the owner of the domain dawidgodziek.com, who grants the Seller the right to use the domain based on a separate agreement; he is not a party to the sales agreements concluded in the Store.

These Terms and Conditions are continuously available on the Store's website in a manner that allows them to be downloaded, saved, and printed.


II. DEFINITIONS

  • Customer – a natural person, a legal entity, or an organizational unit making purchases in the Store;
  • Consumer – A Customer who is a natural person making purchases not directly related to their business or professional activity
  • Seller – the owner of the Store;
  • Goods – products offered in the Store;
  • Sales Agreement – an agreement concluded between the Customer and the Seller;
  • Order Form – a form available in the Store used for purchasing Goods.

III. Placing Orders

  1. Orders can be placed 24/7 via the Store's website.
  2. After selecting the Goods, the delivery method, and the payment method, the Customer confirms the order.
  3. The Sales Agreement is concluded at the moment the Seller confirms the order and sends an e-mail to the Customer.

IV. Prices and Payments

  1. All prices are listed in euros and include VAT.
  2. The price of the Goods is binding at the moment the order is placed.
  3. The delivery cost, as specified during the ordering process, is added to the price.
  4. Payments are processed via the system imoje (online transfers, BLIK, payment cards, Apple Pay, Google Pay).

V. Delivery

  1. The Seller delivers the ordered goods within the territory of the Republic of Poland and to the countries specified in the delivery price list available on the Store’s website.
  2. The delivery method and its cost are presented to the Customer before placing an order, and placing an order constitutes acceptance of the indicated delivery cost.
  3. Within Poland, delivery is carried out by the courier company InPost — the Customer may choose either delivery to an InPost parcel locker or delivery by an InPost courier.
  4. International shipments are carried out via the Paxy.pl platform, which cooperates with local courier carriers operating in the respective destination countries specified in the price list.
  5. The cost and estimated delivery time depend on the destination country, the weight of the shipment and the selected carrier, and are indicated to the Customer when choosing the shipping method, in accordance with the current price list available on the Store’s website.
  6. The delivery time within Poland is up to 5 business days from the date the payment is credited, but no longer than 30 days from the date of conclusion of the agreement.
  7. The delivery time for international shipments may be longer than for domestic deliveries and depends on the destination country, the selected carrier and local logistics procedures; the estimated delivery time for the selected country is indicated to the Customer before placing the order.
  8. In the event of a delivery delay, a Customer who is a consumer is entitled to the rights arising from generally applicable provisions of law, including the right to set the Seller an additional deadline for delivery of the goods and, if that deadline expires without effect, the right to withdraw from the agreement.

VI. Withdrawal from the agreement

  1. The Consumer has the right to withdraw from the agreement within 14 days from the date of receipt of the Goods.
  2. To withdraw from the agreement, a statement must be submitted to the following e-mail address: gb@4-bike.pl.
  3. The Consumer returns the Goods at their own expense to the Seller's address.
  4. The refund will be issued within 14 days from the date of receipt of the returned Goods.
  5. The right of withdrawal does not apply to, among others, personalized Goods.
  6. The right to withdraw from the agreement is also granted to a natural person concluding an agreement directly related to their business activity, when the content of the agreement indicates that it is not of a professional nature for that person, resulting in particular from the subject of their business activity (the so-called "privileged entrepreneur").

VII. Complaints and Statutory Warranty

  1. The Seller is obliged to deliver Goods free from defects.

  2. In the event of a defect in the Goods, the Customer has the right to file a complaint based on the provisions of the Civil Code regarding the statutory warranty.

  3. Complaints may be submitted in electronic form to the following e-mail address: gb@4-bike.pl or in writing to the Seller's registered office address.

  4. It is recommended to provide the following in the complaint:
      a) information and circumstances regarding the subject of the complaint, in particular the type and date of the occurrence of the defect,
      b) a request regarding the method of bringing the Goods into conformity with the agreement, or a statement on price reduction or withdrawal from the agreement,
      c) contact details of the person filing the complaint.

  5. The Seller shall process the complaint within 14 days of its receipt. Failure to respond within this period shall be deemed as acceptance of the complaint.

  6. The rights specified in this paragraph are granted both to Consumers and to natural persons concluding an agreement directly related to their business activity, if the content of this agreement indicates that it is not of a professional nature for them (the so-called "privileged entrepreneur").


VIII. Personal Data

The Customers' personal data are processed by the Seller as the Data Controller in accordance with the GDPR and the Privacy Policy available in the Store.


IX. Guarantee

  1. The products offered in the Store are not covered by a manufacturer's guarantee.
  2. Regardless of the above, the Customer is entitled to rights resulting from the statutory warranty as specified in the Civil Code and described in these Terms and Conditions.

X. Final Provisions

  1. The Seller reserves the right to amend the Terms and Conditions for valid reasons.
  2. The amendments do not affect the rights of Customers resulting from agreements already concluded.
  3. The Consumer has the right to use out-of-court dispute resolution methods, including the ODR platform:

These Terms and Conditions shall be effective as of: September 1, 2025.
